Terms of Service

These terms govern your use of the Foodjin app and website. By signing up, you agree to them. They are written plainly, but they are a binding agreement.

What Foodjin is

Foodjin is a technology platform and marketplace. We connect you with independent halal vendors ("Jins") and independent delivery providers. Foodjin does not prepare, cook, handle, sell, or deliver food or products. Each vendor is the seller of record for the items it lists and is an independent business, not an employee, agent, or partner of Foodjin. Your purchase is a contract between you and the vendor. Foodjin facilitates discovery, ordering, payment, and support, and is not a party to that sale.

Who can use Foodjin

Foodjin is not intended for children under 13, and we do not knowingly allow them to create accounts or collect their information (the federal COPPA).

Orders and payments

Returns, cancellations and refunds

Because orders are prepared fresh by vendors, items generally cannot be "returned." Your remedies are cancellation and refund as set out below.

Halal standards

Foodjin facilitates a halal-focused marketplace. Vendors self-certify their products as halal and are solely responsible for the accuracy of those claims, sourcing, preparation, and labeling. Our "Halal Verified" badge means a vendor has completed Foodjin's vetting process and submitted supporting documentation -- it is a process and documentation signal, not an independent religious certification or guarantee by Foodjin. Foodjin does not warrant the halal status of any item. If you have a halal concern, report it via the Help Center or halal@foodjin.org and we will investigate with the vendor.

Delivery

Delivery may be performed by the vendor (self-delivery), a Foodjin independent driver partner, or a third-party courier network (such as Shipday). Delivery providers are independent contractors or independent companies. Foodjin is not responsible for the acts, omissions, or conduct of any delivery provider beyond facilitating the order and applicable refunds.

Food safety, allergens, and product quality

Vendors are solely responsible for food safety, hygiene, allergen and ingredient information, licensing, and the quality and fitness of what they sell. Foodjin does not inspect, test, or guarantee any item. If you have allergies or dietary requirements, confirm directly with the vendor before ordering.

Disclaimer of warranties

The Foodjin platform is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Foodjin does not warrant that the platform will be uninterrupted or error-free, or that any item, halal claim, or delivery will meet your expectations.

Limitation of liability

To the maximum extent permitted by law, Foodjin and its officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, illness, allergic reaction, loss, or damage arising from food, products, halal claims, or delivery provided by vendors or delivery providers. Foodjin's total liability for any claim relating to an order is limited to the amount of Foodjin's service fee on that order. Some states do not allow certain limitations, so some of these may not apply to you, and nothing here limits liability that cannot be limited by law.

Your responsibility and Foodjin's zero risk

You are solely responsible for the orders you place. The vendor is solely responsible for its products -- their quality, fitness, safety, ingredients, allergens, and any defect. As a facilitator only, Foodjin carries no risk and no liability for the transaction, for the products, or for any harm, illness, injury, allergic reaction, or loss arising from them, including from a vendor's lack of food safety. Any claim over a product or an order is between you and the vendor, and you look solely to the vendor for it.

Foodjin's rights and final decisions

Your conduct

Do not use Foodjin to harass vendors, drivers, or other users; place fake orders; resell items; or scrape or copy our content. We may suspend or ban accounts that do.

Your content

You keep ownership of the reviews, ratings, and photos you submit, and you grant Foodjin the license described in our Privacy Policy to use them. Do not submit content that is unlawful, infringing, or that you do not have the right to share. Foodjin complies with the Digital Millennium Copyright Act (DMCA); to report infringing content, email support@foodjin.org with the information the DMCA requires.

Communications consent

By creating an account, you consent to receive transactional messages (order, account, and delivery notices) by call, text, and email. Marketing messages are sent only where permitted; reply STOP to opt out of marketing texts (federal TCPA) and use the unsubscribe link to opt out of marketing emails (federal CAN-SPAM Act). Message and data rates may apply.

Electronic agreement

By creating an account or tapping to accept, you agree to contract electronically under the federal E-SIGN Act and the Michigan Uniform Electronic Transactions Act. Your electronic acceptance has the same legal effect as a handwritten signature.

Governing law, arbitration, and class-action waiver

These terms are governed by the laws of the State of Michigan and applicable U.S. federal law, without regard to conflict-of-law rules. Mandatory consumer-protection rights under the law of the state where you live still apply and are not waived.

Informal resolution first. Most issues can be resolved by emailing support@foodjin.org. You agree to try to resolve any dispute informally for at least 30 days before starting arbitration.

Binding arbitration. If we cannot resolve it, you and Foodjin agree that any dispute will be resolved by binding individual arbitration under the Federal Arbitration Act, seated in Michigan, rather than in court. You and Foodjin waive the right to a jury trial and the right to bring or join a class action, to the fullest extent permitted by law.

Exceptions. Either party may instead bring an eligible claim in small-claims court, or seek injunctive relief to protect intellectual property or confidential information, without arbitrating.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@foodjin.org within 30 days of first accepting these terms. Opting out does not affect the rest of these terms.

Changes to these terms

We may update these terms. For material changes, we will notify you by email or in-app banner at least 7 days before they take effect.
